چکیده

In an influential case (Neil v Biggers, 1972), the U S Supreme Court identified five catena to be considered m judging eyewitness identification evidence The Court's intuitions may need reassessment m light of recent psychological research evidence Especially in need of review is the assumption that eyewitness certainty and eyewitness identification accuracy are usefully related Under a variety of procedures that mimic the real-world environment, experiments have found the relationship between eyewitness accuracy and confidence to be of little or no practical use In addition, the Court's assumption that the degree of the eyewitness's attention is cntical to judging the accuracy of the eyewitness can be refined for the trier of fact. Psychological research can also bear directly on refining the Court's reference to the witness's opportunity to view the criminal, especially with regard to systematic biases in witnesses' estimations of temporal duration The Court's reference to an eyewitness's accuracy of prior description as a cue to accuracy of identification is questionable Finally, the Court's reference to decay of memory across time should be refined to include concepts of interference (1 e , consideration of retention interval events rather than time, per se) Although the Court's intuitions about eyewitness identification are not unreasonable, the recent growth of a literature using forensically relevant procedures has increased the gap between experimental evidence and the Biggers criteria

The perceived validity of eyewitness identification testimony: a test of the five Biggers criteria.

The U.S. Supreme Court has outlined five criteria on which evaluations of eyewitness identifications should be based (certainty, view, attention, description, and time; Neil v. Biggers, 1972). We postulated that certainty plays a qualitatively different role from the four other Biggers criteria in evaluations of eyewitness identification testimony. Specifically, we hypothesized that participant...

The confidence-accuracy relationship in eyewitness identification: effects of lineup instructions, foil similarity, and target-absent base rates.

Discriminating accurate from mistaken eyewitness identifications is a major issue facing criminal justice systems. This study examined whether eyewitness confidence assists such decisions under a variety of conditions using a confidence-accuracy (CA) calibration approach. Participants (N = 1,200) viewed a simulated crime and attempted 2 separate identifications from 8-person target-present or t...

Multiple confidence estimates as indices of eyewitness memory.

Eyewitness identification decisions are vulnerable to various influences on witnesses' decision criteria that contribute to false identifications of innocent suspects and failures to choose perpetrators. An alternative procedure using confidence estimates to assess the degree of match between novel and previously viewed faces was investigated. Classification algorithms were applied to participa...

Eyewitness testimony research: Current knowledge and emergent controversies

Psychological research on eyewitness testimony has flourished over the last decade and there are now a number of findings that appear relevant to police and courts. We review some of the major eyewitness research findings regarding such things as the relationship between accuracy and confidence, the identification of perpetrators from lineups, and the influence of misleading information on eyew...

Eyewitness Identification

Eyewitness identifications play an important role in many police investigations and courtroom decisions. Identification decision accuracy is shaped not only by the quality of a witness’s memory but also by social-influence variables. Some variables can be categorized as general impairments, whereas others produce biases against a specific suspect. We review some of the key variables in each cat...
